KNAP TOURS TERMS AND CONDITIONS OF BOOKING

The following Terms and Conditions form the basis of your contract with Knap Tours LTD (hereinafter referred to as “Knap Tours”). Please read them carefully as they are legally binding.
1. APPLICATION
All inquiries, advice, quotes, travel schedules, estimates made, reservations made with and/or services provided by or on behalf of Knap Tours are subject to these Terms and Conditions.
2. THE CLIENT AND AUTHORITY
The person who requests the quote or information, or makes the reservation or receives any type of service, will be understood to have read, or have been explained to him (when applicable), and that he/she has understood and accepted the Terms and Conditions.
3. THIRD PARTY SERVICES AND PROVIDERS
Knap Tours offers its clients travel, transfers, tours, accommodations, activities, excursions or other services, either acting as itself or as an Agent for participating Suppliers, or for partners in the tourism industry. (collectively referred to as “Vendors”). Knap Tours represents the Suppliers and, accordingly, does not accept any responsibility for any loss, damage, injury, illness, damage or death that any Client may suffer as a result of any act or omission by the Suppliers in fulfilling with their obligations, whether in connection with the organisation of the trip, accommodation or otherwise unless, in the case of injury or death, it is due to the act or omission of the Supplier due to negligence. The Provider’s contract in use (which is often constituted by the voucher or reservation number issued by the Provider), will constitute the only contract between the Provider and the Client and any right of recourse that the client may have, will be solely against the Supplier. The Travel Agent will provide the Client with the identity, terms and conditions (or access thereto) all Suppliers relevant to the Client. It is the Client’s responsibility to familiarise himself/herself with the Provider’s Terms and Conditions.
4. PASSPORTS AND CHILDREN
Parents travelling with children, without the other parent, will need a certified letter from the police with the consent of the absent parent. This letter must be translated into English by a sworn translator. In addition, it must be taken into account that it is necessary to have a valid passport for at least 6 months after the start date of the trip. Parents travelling with children under 18 years of age will have to travel with the minor’s birth certificate translated into English through a sworn translation. All passports must have at least two consecutive blank pages. Failure to comply with these rules may result in immediate deportation to the country of origin at the Customer’s expense. Passengers weighing 100 kg or more must notify Knap Tours, as an additional seat must be reserved and quoted in the reservation. For some transport, it is necessary to request the weight of all passengers as part of the reservation and confirmation process, this information is necessary for the distribution of the weight.
5. CARS AND VEHICLE RENTAL
The Vehicle Rental is linked to the contracts with the Vehicle Rental companies. It is the Client’s responsibility to ask about all the applicable Terms and Conditions and constituted by the Vehicle Rental Company before making the payment. The client will be responsible for all traffic fines and toll fees. It is important to always return the vehicle with a full tank, in case the vehicle is not returned in this way, a charge will be made on the customer’s card by the Car Rental company to refill the gas tank. It is advisable to thoroughly check the vehicle with a representative of the car rental company upon collection and return of the vehicle, and ensure that any damage, scratches, defects or deficiencies that the vehicle may have are notified, specified and shared with the said representative. The Car Rental voucher and reservation number will constitute the sole contract between the Car Rental company and the Client, and any right of appeal that the Client may have, will be solely against the Car Rental company in accordance with the terms established by the Car Rental Company.
6. DEPOSIT AND RESERVE
Once the client has requested a travel proposal verbally, by email or directly through the web (which has its payment gateways), Knap Tours will prepare a travel program according to what has been established. You will have to make a deposit of 60% of the total trip (including the transport between Johannesburg and Hoedspruit once you arrive in South Africa). No reservation will be confirmed if the deposit and written confirmation of acceptance of the Quotation is not received.
7. PAYMENT AND PAYMENT TERMS
The bank expenses when making the payment via bank transfer, will be borne by the client. After presenting the invoice, in order to complete the reservation and confirm the trip, the payment of a 60% deposit will be required. The remaining 40% of the total services that complete the final payment must be made 30 days before the start date of the trip. If the final payment is not received on time, the trip will be cancelled. If the Client does not proceed with the Payment 24 hours after Knap Tours has sent the invoice and the price of the quoted transport increases, the Client will be responsible for this price increase and the difference will be borne by the Client.
8. PRICES
The prices are quoted according to the exchange rate of the day. Until Knap Tours has received payment of the Price in full, it reserves the right to charge any fluctuations to the Client’s account and the Client agrees to pay any fluctuations where applicable. It will be the Client’s responsibility to verify that there have been no changes in the Price before making the full and final payment. However, once payment of the price in full is received, the price is guaranteed. However, airfares are subject to the price and conditions indicated by the airlines and cannot be guaranteed by the Travel Agency. In the event that the Client is a group reservation and the number of the group varies from the original number at the time of making the reservation, the Provider reserves the right to re-quote the Price and add an extra charge. If any Client refuses to accept and pay the surcharge, it may result in the cancellation of the entire reservation and retention of any payment made. Knap Tours shall be entitled to retain fees for services charged. It must be taken into account that in some cases the Suppliers may demand to pay an additional clause to the passengers in the case of the increase in the price of fuel despite the fact that full payment has been made. Liability, Limitation of Liability and Indemnity The Travel Services Organization Proposal is made on the express condition that Knap Tours, its employees and travel agents, will not be responsible for, and will be exempt from all liability in case of loss (financial or otherwise), damages, accidents, injuries, illnesses, trauma, death, delay or additional expenses incurred by any Customer, their baggage, or other property, regardless of their cause whether or not due to any act, omission, breach or negligence on the part of Knap Tours. It is highly recommended that all Clients obtain adequate insurance coverage, covering situations such as cancellation due to illness, accident or injury, personal accident and personal liability, loss of or damage to luggage. Knap Tours will not be liable if the Client does not have adequate insurance coverage. It will not be mandatory for Knap Tours to take out travel insurance for the Client. The Client must take into account that several credit card companies offer limited travel insurance, such insurance is not recommended by Knap Tours as sufficient coverage for international travel. It is recommended to check with the credit card company to obtain adequate information on the aspects covered by the insurance.
9. TRAVEL DOCUMENTS
Documents such as vouchers, vouchers, reservation numbers, complete itineraries, etc. they are only prepared and released upon receipt of payment of the price of the trip contracted in its entirety. The Client, after receiving all his travel documents, has the responsibility to verify that all the details are correct.
10. PASSPORTS, VISAS AND HEALTH
It is the obligation and responsibility of the Client to ensure that all their passports and visas are up to date, have been obtained on time, and are valid for six months after the date of return to the country. Knap Tours undertakes to assist the client, but such assistance will be at the discretion of the Travel Agent and the Client acknowledges that by doing so, Knap Tours assumes no obligation or liability and the Client will not indemnify Knap Tours for any breach. All visitors to South Africa and all Customers travelling from South Africa to another country are required to have two consecutive sides of blank visa pages (i.e. one left and one right page) in the passport excluding the front and back. back cover for the visa to be issued. If a passport does not meet these requirements, you will not be allowed to board the plane or you will risk deportation on arrival. The Client must ensure that the information provided to Knap Tours reflects the information that appears in his passport for international travel. In addition, it is mandatory to have a return ticket, and it is the Customer’s responsibility to ensure that all documentation is in order before departure.
11. MALARIA AND OTHER TROPICAL DISEASES
Certain parts of your itinerary may be areas where there is a high risk of malaria and other tropical diseases. We strongly recommend that you take the necessary precautions in this regard, for this you must consult your doctor before departure. If the Client has not done so before departure, it is recommended that they do so upon their return.
12. YELLOW FEVER
Some countries in South Africa require a yellow fever vaccination certificate. Requirements vary based on your destination, the country you are from, and which countries were previously visited. Customers travelling from the following countries or visiting these countries together with other countries in South Africa will need proof of vaccination against yellow fever: Angola, Argentina, Benin, Bolivia, Brazil, Burkina Faso, Burundi, Cameroon, Central African Republic, Chad, Colombia, Congo, Ivory Coast, Democratic Republic of the Congo, Ecuador, Equatorial Guinea, Ethiopia, Guyana, Gabon, Gambia, Ghana, Guinea, Guinea-Bissau, Guyana, Kenya, Liberia, Mali, Mauritania, Niger , Nigeria, Panama, Paraguay, Peru, Rwanda, Sao Tome and Principe, Senegal, Sierra Leone, Somalia, Sudan, Suriname, Togo, Trinidad and Tobago, Uganda, the United Republic of Tanzania and Venezuela. The client must take into account that the yellow fever vaccine must be administered at least 10 days before departure. It is the Customer’s responsibility to check with the appropriate embassy of their intended destination.
13. CANCELLATION
Knap Tours reserves the right to cancel any trip prior to departure, in which case full payment will be returned to the Client without any further obligation on the part of Knap Tours. The maximum cancellation fee that can be imposed in the event of cancellation by the Client is as follows:
Cancellation before 30 days from the start of the trip (including the 30th day) – 25% of the cost of the trip is forfeited.
Cancellation between 29 and 15 days before the start of the trip (including the 15th day) – 50% of the cost of the trip is forfeited.
Cancellation between 14 and 8 days before the start of the trip – 75% of the cost of the trip is forfeited.
Cancellation less than 7 days before the start of the trip – 100% of the cost of the trip is forfeited.
The Customer should note that some of our suppliers’ cancellation policies may be stricter than our policy above and Knap Tours is entitled to pass on such additional cancellation charges to the Customer in the event of such an occurrence.
If the Suppliers agree to a refund in excess of the Knap Tours Terms and Conditions of Cancellation, the Customer will receive such amount.
14. UNSCHEDULED EXTENSIONS
In the unlikely event that the extension is not scheduled in the final itinerary, and is caused by flight rescheduling, flight delays, bad weather, strikes, or any other cause beyond the control of Knap Tours; the expenses related to these unscheduled extensions (accommodation, etc.) will be borne by the Client.
15. ITINERARY VARIATIONS
Knap Tours reserves the right to make changes for the ultimate convenience of the Client, for example in some cases, weather conditions may require a modification to the itinerary and this does not constitute any reason for a refund.
16. APPLICABLE LAW AND JURISDICTION
British legislation and the jurisdiction of the British courts will govern the relationship between the Client and Knap Tours. Knap Tours shall have the right to bring an action in court in any court of first instance, notwithstanding that the amount in question may exceed the limits of that jurisdiction. This Agreement will be governed by the laws of the United Kingdom and will be enforced by the courts of the United Kingdom. If Knap Tours has to take legal action against you to enforce payment of amounts due, you shall be responsible for paying all costs that Knap Tours incurs in making payment. If Knap Tours is unable to perform all or any of its obligations under this Agreement due to an event beyond its control, Knap Tours will be released from its obligations under the Agreement for the period such event and its consequences continue, but only to the extent prevented and shall not be liable for any delay or failure to perform such obligations or loss or damage you may suffer as a result of such delay or failure.
17. REQUIREMENTS AND SPECIAL NEEDS
Those Clients who have special requirements and needs must specify such requirements and needs to Knap Tours. Although Knap Tours will do its best to accommodate them, there is no guarantee that this will be the case.
18. RECTIFICATIONS
No modification, cancellation, rectification or waiver of any term or right mentioned in this document will be considered valid or binding unless in writing and signed by the Client and a duly authorised representative of Knap Tours.
19. REFUND AND CHANGES
Refunds will be subject to the Terms and Conditions. Refunds are subject to the General Conditions. Refunds will be made within 14 days of the cancellation of the trip.
20. FORCE MAJEURE SITUATIONS
Knap Tours has the right to cancel any contract if its performance is prevented, hindered or frustrated by strike, lockout, civil disturbance, war, acts of God, acts of God, lack of materials, law or regulations, order issued by the authorities duly constituted by law or for any other cause beyond the control of Knap Tours. The Force Majeure concept includes renovations that may be carried out in the accommodation – the travel agent will do everything possible to provide updated information about it, and the accommodation will do everything possible to avoid and minimise possible inconvenience caused, the fact of that a restoration or renovation is taking place, does not constitute grounds for any claim against Knap Tours. Knap Tours will always do everything possible to recover, in situations where it is necessary, the money from the parties involved that has been paid by Knap Tours on behalf of the Client. All monies recovered by Knap Tours will be refunded to the client for less than a 10% (ten percent) administration fee. Fees charged by Knap Tours are non-refundable.
21. RESERVATIONS ON THE INTERNET
If the client requests or instructs Knap Tours to make reservations through the Internet, the client irrevocably authorises Knap Tours to do the following on their behalf (1) make the selections of and for their Travel Proposal (2) make the payments and (3) accept the reservation conditions.
22. DRIVER’S LICENCE
Even when possessing the International Driving License, the Client must carry his National Driving License with him. The Client is aware that in South Africa you drive on the left side.
23. CONFIDENTIALITY
Subject to legal restrictions, Knap Tours undertakes to treat all Client information of a personal nature in the strictest confidence.
24. RATES AND SURCHARGES
Wherever possible, taxes, fees and carrier surcharges will be reflected in all prices. Please note that some companies incur additional taxes and/or surcharges if changes are made to tickets, even if the ticket has been paid in full.

26. CONSUMER PROTECTION LAW
We support the intent of the Consumer Protection Act, which governs business interactions between a seller and a buyer for products/services that are consumed in South Africa. We believe in an honest, transparent, ethical and fair business practice.
27. CHANGES TO THE TERMS AND CONDITIONS
The Company reserves the right to make changes to the Terms and Conditions at any time without notice.
